Incineration Norms — Czech Republic (2025)

Incineration Norms

  • Incineration in the Czech Republic is used mainly for waste-to-energy (WtE), but accounts for a smaller portion of municipal waste treatment compared to landfill and recycling.
  • Current Standards & Practices:
    • The Waste Act (No. 541/2020 Coll.) is the principal legislation for waste management, setting strict rules for waste sorting, diversion from landfill, and incineration.
    • Energy recovery via incineration is prioritized for waste that cannot be efficiently recycled.
    • Incineration facilities must comply with the EU Industrial Emissions Directive (IED) and Czech national emission limits:
      • Particulate matter: 10mg/m³
      • SO2: 50mg/m³
      • NOx: 200mg/m³
      • CO: 50mg/m³
      • Dioxins and furans: 0.1ng I-TEQ/m³
    • Continuous emissions monitoring and public reporting are required.
    • No specific incineration tax is applied (as of 2025). Policy focus is on diversion from landfill, not discouraging incineration.
  • Municipalities are obligated to ensure at least 60% separate collection of municipal waste by 2025, with landfill bans for high-calorific and recyclable waste set for 2030.

Governing and Monitoring Authorities

  • Ministry of the Environment of the Czech Republic: Main government body for waste policy, regulation, facility licensing, and compliance with EU law.
  • Regional Environmental Offices: Oversee permitting, inspection, and enforcement at facility and municipal levels.
  • Municipal Governments: Responsible for waste collection, reporting requirements, and setting local fees (pay-as-you-throw options).

Key Legislation & Standards

  • Waste Act (No. 541/2020 Coll.): Core law regulating sorting, recycling, incineration, and landfill bans for certain waste streams.
  • Decree No. 273/2021 Coll.: Defines reporting requirements and methodology for separate collection targets.
  • EU Industrial Emissions Directive (2010/75/EU): Incorporated into Czech law for all waste incineration operations.
  • Act No. 565/1990: Provides municipal authority over fee setting for waste services.
